Mid-Year Real Estate Market Update for the Charleston, SC Metro Area

The Charleston Trident Association of Realtors (CTAR) put together this market update (click to view presentation):

2011 Midyear Residential Market Update
This update didn't really have big surprises:
  • Foreclosures are still placing downward pressure on prices
  • The recovery is going to be slow, depending on employment the real estate market may start to recover between 2012 and 2014
  • Sales activity is still at very healthy level, and inventory is still coming down.

What this update fails to mention is that:

New Photo Requirements For Appraisals

Home AppraisalsJoAnn Terrell from Bank of America sent us this information today, which we thought was interesting to share with everyone, especially with our friends the appraisers:

New Subject Property Photo Requirements - On the all interior inspection assignments, including FHA and Conventional, the appraiser must include, at a minimum, the following photographs:

  • The kitchen
  • All bathrooms
  • Main living area
  • Examples of physical deterioration, if present
  • Examples of recent updates, such as restoration, remodeling and renovation, if present
  • All modifications/additions to the exterior of the subject
  • Exterior pictures of front, street, rear and sides of the...

Good News from the Government!

Tax Credit Closing Deadline Extended
After a close brush with the deadline, Congress has passed an extension of the Homebuyer Tax Credit closing deadline, the Homebuyer Assistance and Improvement Act (H.R. 5623).

The extension applies only to transactions that have ratified contracts in place as of April 30, 2010 that have not yet closed.  The legislation is designed to create a seamless extension the new closing deadline for eligible transactions is now September 30, 2010.  There is will be no gap between June 30 and the date the President signs the bill into law.

LAST MINUTE HICCUPS...!

Don't PanicIn our own experience, and also through our discussions with fellow Realtors, it appears that recently about 8 out of 10 purchase transactions have had "last minute" surprises  that may have delayed or upset the closing in some shape or form. 

Normally, these "hiccups" are due to the financing. Underwriters (and transaction auditors, a second "firewall" established recently by a few large banks) are under the gun and are checking and re-checking all loan applications with a fine tooth comb SEVERAL TIMES.

Is Arbitration for Real Estate Always Enforceable in SC?

Arbitration ProcessAttorney Clay Olson recently published a blog post analyzing a recent decision by the SC Court of Appeals in the matter of Faltaous v. Anderson Ocean Club Development, in which the "mandatory arbitration" clause was denied by the court. 

According to Olson, this means that SC courts may not enforce the mandatory arbitration as a matter of course, and it will depend on each individual case, and how specific the language to be enforced reads. 

Bottom line: Builders and real estate practitioners need to get sound legal advice on how to word arbitration clauses properly if they want them to be enforceable in SC.

SC Legislature Considering Tax Break for Second Home Owners

The South Carolina state legislature is considering new legislation to allow second home owners who cannot sell one or have to move for a new job to pay a lower property tax rate. Currently, these owners pay a higher property tax rate for properties they own but don't live in full-time.

The proposed legislation is still at the committee level, but one provision would make taxes on second homes the same as for the primary residence. Another proposal suggest a five-year tax break if someone buys a home to pursue a new job at least 150 miles away from his/her primary residence.

BUYER BEWARE- New HUD & Good Faith Estimate Forms May Cause Delays

The Federal Government has changed the forms used for lenders' Good Faith Estimates (GFE's) and closing statements (HUD-1) to improve the level of disclosure and make it easier to compare between different lender quotes.

Although their intention is good, these changes may cause some chaos until they sort out the problems they may bring to lenders, real estate agents and attorneys.

The impact of an expanded government tax break for homebuyers trickled up in the Charleston area last month as the incentive appears to have given local prices a nudge.

Sales activity increased in the $200,000 to $250,000 range during December, helping push the median home price up by about 2 percent to $195,534 -- its highest point for 2009.

In all, the Charleston Trident Association of Realtors recorded a total of 618 local home sales last month, a 30 percent increase from the December 2008...

APPRAISAL BELOW YOUR CONTRACT PRICE?

Here is a situation that unfortunately is becoming very common: Appraisals that are coming substantially BELOW THE CONTRACT PRICE!

Why is this happening?

The main reasons for this new trend are:

  1. Recent CHANGES IN GOVERNMENT REGULATION (namely the Home Valuation Code of Conduct - HVCC) that dictated that lenders cannot choose an appraiser directly any more (lenders normally would choose an appraiser they know is familiar with the neighborhood). Instead, they have to order the appraisal through a third party company, who in turn has a "pool" of registered appraisers to whom they farm out the jobs. This has caused some appraisals to be conducted...
